Frank I. Michelman: The Case of Liberty
Frank I. Michelman (Robert Walmsley University Professor at Harvard University specializing in constitutional law, philosophy of law, property law and municipal law)
I: Liberty, Liberties, and “Total Freedom”
II: Contract versus Common Ground?
The lectures consider the concepts of contract, consensus and ethical values in relation to the justification of democratic orders. In doing so, they explore the question of whether a strong distinction between contract-based and value-based justificatory orders can be maintained. This question is framed by considering different approaches to defining constitutionally protected freedoms, as found in John Rawls and Ronald Dworkin.
