Russian assets for the reconstruction of Ukraine?
In view of the immense damage caused by the Russian attack on Ukraine, the confiscation of confiscated Russian foreign assets is being considered in the political sphere and in parts of legal scholarship in order to use them to settle Ukrainian reparation claims. This article examines the implications of this demand in terms of international, union and constitutional law and comes to the conclusion that expropriation meets with legal reservations, but that confiscation to secure claims to be settled in the future is permissible.
