What should be considered fundamental and human rights must be negotiated again and again by those entitled to them. This volume shows how this happens and how tense this process is. Internationally, the courts are particularly important, such as the European Court of Human Rights in Strasbourg and the European Court of Justice in Luxembourg. At the national level, the focus is on the allocation of powers to constituent assemblies, parliaments and courts. It is clear that despite all the standardization in Europe, there is a great deal of national diversity.
