The use of algorithmic decision-making systems (ADM systems) poses new challenges for anti-discrimination law. ADM systems have a high potential for discrimination, but discrimination often remains hidden. This legal opinion examines the extent to which the General Equal Treatment Act (AGG) is suitable for dealing with discrimination through ADM systems. The draft of the so-called AI Regulation is also included in the examination. It discusses which gaps in protection exist in the AGG for those affected by discrimination through ADM systems, how they can be closed and how the area of law enforcement can be strengthened.
